Regulations of the E.Wedel Chocolate Factory


1. The following Regulations set out the rules that apply in the commercial space located at al. E. Wedel 5 in Warsaw, Poland, owned by LOTTE Wedel sp. z o. o. with its registered office in Warsaw, at ul. Zamoyskiego 28/30, NIP [Tax Id. No.]: 5272613819, REGON [National Business Registry No.]: 142078650 hereinafter referred to as the “E.Wedel Chocolate Factory”.
2. The E.Wedel Chocolate Factory is an interactive space where the history and process of chocolate making is told, as well as the story of the Wedel family who created the unique brand.
3. In addition to the exhibition and installations, the E.Wedel Chocolate Factory also has spaces for conducting workshops, temporary exhibitions, and other broadly understood cultural and entertainment activities.
4. The Regulations should be observed by each person who uses the offer on the premises of the E.Wedel Chocolate Factory.
5. Visitors to the E.Wedel Chocolate Factory should follow the instructions of the staff, especially the guides.


§1 Rules for visiting the exhibition at the E.Wedel Chocolate Factory
1. The business days and opening hours of the E.Wedel Chocolate Factory are listed at www.fabrykaczekolady.pl. The space may be temporarily closed due to restoration work and other activities. Information about changes in opening times will be posted on the website www.fabrykaczekolady.pl well in advance.
2. The tour time of the exhibition is 90 minutes. After visiting the exhibition, visitors can view the other spaces of the building open to the public on their own. The terrace is available only during favourable weather.
3. Tours of the E. Wedel Chocolate Factory take place in groups of 30 people, who enter the exhibition every 15 minutes. Organised groups of more than 30 people will be divided into smaller groups. We recommend that members of an organised group be over 5 years of age.
4. Entry to the exhibition is on the day and time specified on the ticket.
5. Due to safety rules, the number of visitors staying on the premises of the E.Wedel Chocolate Factory building is limited.
6. It is allowed to take pictures and record video on the premises of the E.Wedel Chocolate Factory, except for commercial purposes such as professional photographic shoots and advertising, as well as shoots that require lamps, tripods and other additional equipment.
Visitors to the E.Wedel Chocolate Factory may touch the exhibited items intended for this, use the exhibits in accordance with their intended purposes, however, it is prohibited to damage or destroy any exhibits and equipment located at the E.Wedel Chocolate Factory.
Liability for damage caused by minors shall rest with their adult guardians.
7. Persons under 13 years of age may visit the E.Wedel Chocolate Factory when accompanied by an adult guardian.
8. The E. Wedel Chocolate Factory is adapted to the needs of people with disabilities.
9. It is not permitted to bring animals (except service dogs) into the E. Wedel Chocolate Factory.
10. The E. Wedel Chocolate Factory is not responsible for items left behind by visitors, especially in exhibition areas and the cloakroom areas.
11. Consumption of meals on the premises of the E. Wedel Chocolate Factory is possible only in places designated for this purpose.
12. It is forbidden to bring and consume alcoholic beverages and other intoxicants, as well as to smoke tobacco products, including e-cigarettes, on the premises of the E.Wedel Chocolate Factory.
13. The air in the E. Wedel Chocolate Factory may contain traces of the following allergens: peanuts, nuts, cereals (gluten).
14. The E. Wedel Chocolate Factory does not have a place to store luggage.
15. In the event that an organised group is late for a tour (not more than 10 minutes), the tour shall be shortened by the same amount of time the group was late, and the course of the tour shall be determined by the guide. Being more than 10 minutes late for the scheduled time will result in the cancellation of the tour.
16. The Museum grounds are protected and monitored using electronic security systems.

 

§2 Sale of tickets for exhibitions, workshops and other activities offered by the E.Wedel Chocolate Factory
1. Only holders of relevant tickets may enter and partake in exhibits, workshops, and other activities offered by the E.Wedel Chocolate Factory. The price list for tickets is available at www.fabrykaczekolady.pl.
2. Tickets can be purchased at www.bilety.fabrykaczekolady.pl or at the ticket counter and ticket machine at the E.Wedel Chocolate Factory.
3. The purchase of tickets is subject to the availability of seats.
4. The ticket counter accepts payment in Polish zlotys (PLN) and accepts payment cards - information on supported card types is available at ticket counters and on the website www.fabrykaczekolady.pl.
5. The need for a VAT invoice must be requested at the time of purchasing tickets online or at the time of booking in the case of reservations through Customer Service.
6. As part of an individual tour, each person can purchase up to 9 tickets per reservation. Organised groups of at least 10 people are entitled to purchase group tickets.
7. The Buyer’s payment of the price for the Tickets is made through the www.platnosci.pl website operated by the PayU payment system, by online bank transfer, or by payment card. A detailed description of payment methods and processing of payment complaints is specified in the PayU system regulations, available at https://poland.payu.com/wp content/uploads/sites/14/2020/03/Regulamin_systemu_PayU_3.pdf. The Museum is not responsible for any malfunction of the PayU payment system.
8. After paying for the online order, the sales system generates electronic tickets, which are sent as a pdf file to the email address provided in the order.
9. The purchased ticket (in paper or electronic form) must be presented to the employee at the entrance. If you purchase a discounted ticket, you will also need to show a document entitling you to the discount.
10. Tours and participation in workshops at the E.Wedel Chocolate Factory in organised groups is possible after purchasing a ticket through the website www.fabrykaczekolady.pl (hereinafter referred to as the “Website”) or prior reservation by e-mail to: [email protected].
11. Tickets for a tour of the E. Wedel Chocolate Factory can be returned until 3 calendar days before the booked tour date (not included). It is not possible to return tickets purchased less than 3 days before the booked tour date. If tickets for a tour without a guide are paid and not returned earlier than 3 days before the tour date, the tickets are non-refundable and are considered sold.
12. Tickets for workshops can be returned until 7 calendar days before the booked date of the workshop (not including this date). It is not possible to return tickets purchased less than 7 days before the booked date of the workshop. If tickets for stand-alone workshops are paid for and not returned earlier than 7 days before the workshop date, the tickets are non-refundable and are considered sold.

 

§3 Rules of participation in workshops organised at E.Wedel Chocolate Factory
1. Any person holding a ticket for the date and time specified in the ticket is entitled to participate in the Workshops. The number of participants at the workshop is limited.
2. The price list, programme, schedule, and length of the workshop is described at www.fabrykaczekolady.pl (“Website”).
3. The workshop uses products that can cause allergic reactions in some people (such as nuts, almonds, gluten, lactose, etc.).
4. The staff has the right to refuse entry to the workshop to late comers.
5. The Participant is obliged to observe basic hygiene rules during the Workshop, which will be presented to the Participant by the instructor before the Workshop.
6. The participant is obliged to follow the recommendations, orders and instructions of the Workshop leader and the health and safety rules in force in the room where the Workshop is conducted.
7. The Participant shall be liable for damages caused during the Workshop to themselves or to other Participants, which are the result of their negligence or careless/negligent or reckless conduct.
8. The Participant shall be responsible for damage to devices/equipment/property caused during the Workshop, which is the result of their negligence or careless/negligent or reckless conduct.

 

§4 Personal data protection
1. The controller of the personal data of visitors to the E.Wedel Chocolate Factory shall be LOTTE Wedel sp. z o.o. with its registered office in Warsaw (03-801), ul. Zamoyskiego 28/30.
2. Providing personal data is voluntary, but necessary for booking and purchasing tickets or services. The consequence of not providing the personal data required by the E.Wedel Chocolate Factory is the inability to process the order and provide services.

4. Personal data will be processed for the purpose of preparing and implementing the sale of tickets or services at the E.Wedel Chocolate Factory, including through the Website (www.fabrykaczekolady.pl), based on Article 6(1)(b) of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter: “GDPR”).
5. The catalogue of personal data collected and processed depends on the type of entity for which the reservation and purchase of tickets or services are made:
        a) in case of ticket reservation and purchase by an individual without a VAT invoice:
                i. mandatory data: name, email address;
                ii. optional data: country, postal code, telephone number;
        b) in case of reservation and purchase of tickets by an individual for an individual with a VAT invoice:
                i. mandatory data: name, e-mail address, country, address of residence (street, building and/or premises number, postal code, city);
                ii. optional data telephone number;
        c) in case of reservation and purchase by an individual for a business entity with a VAT invoice:
                i. mandatory data: first and last name, e-mail address, country, full details of the business entity for VAT invoice (name, VAT number, address i.e. street, building and/or premises number, postal code, city);
                ii. optional data telephone number.
        d) in case of realization on behalf of an individual of the design service of packaging of Ptasie Mleczko® marshmallows:
                i. mandatory data: e-mail address.
6. Recipients of personal data processed for the purpose of reservation and purchase of tickets or services may be: providers of IT systems and IT services, service quality research, debt recovery, legal, analytical, marketing services, operators of electronic payment systems, and banks for payment processing, authorities entitled to receive such personal data under the law.
7. The entities we work with are primarily based in countries in the European Economic Area (EEA) or in Switzerland, recognized as a country that meets an adequate level of personal data protection. Some of our suppliers and service providers that we work with, such as Google LLC, are based outside the EEA. We transfer Personal Data outside the EEA only when absolutely necessary and only to countries that provide an adequate level of protection for Personal Data or after prior verification to ensure that these entities provide guarantees of a high level of protection for Personal Data. These guarantees derive, in particular, from the obligation to apply the standard contractual clauses adopted by the Commission (EU) or participation in the Data Privacy Framework program established under Commission Implementing Decision (EU) 2023/1795 of July 10, 2023, based on Regulation (EU) 2016/679 of the European Parliament and of the Council, stating the adequate level of personal data protection provided under the EU-US Data Protection Framework.
8. Personal data will be processed for the time necessary to perform all obligations arising from the sale of tickets or services. In the case of personal data processed for the purpose of providing electronic services - for the duration of the provision of electronic services. In the case of personal data processed for the purpose of directing marketing content by the E.Wedel Chocolate Factory - until you object to the processing of personal data in this regard. After this period, personal data will be processed only to the extent and for the time required by law, including accounting regulations.
9. The data subject has the right to access the content of the data provided and, subject to the law, the right to rectification, erasure, restriction of processing, the right to data portability, the right to object.
10. The data subject has the right to lodge a complaint with the supervisory authority in charge of personal data protection, i.e. the President of the Office for Personal Data Protection, if he/she considers that the processing of personal data concerning him/her violates the provisions of the GDPR.
11. The data subject’s personal data will not be processed by automated means, including profiling without separate consent.
12. Detailed rules for the processing of personal data on the Website are set out in the Privacy Policy and E.Wedel Chocolate Factory ticket counters.
13. You may obtain more information on how to exercise your rights, as specified above, by contacting LOTTE Wedel sp. z o.o. in the manner specified in paragraphs 1 and 3.

 

§5 Final provisions
1. Visitors can file complaints, grievances, requests about the Museum’s activities, its program and customer service. Complaints can be sent by email to [email protected] In order to be examined, complaints must include the name of the person submitting it, address (postal or electronic) and a detailed description of the subject of the complaint. If the data contained in the complaint is insufficient, the Museum will ask the complainant to provide the required information. A properly filed complaint will be reviewed by the Museum within 30 calendar days of receipt of the complaint. The answer will be sent to the address provided in the complaint. The Museum is not responsible for incorrectly submitted complaints, especially if the Visitor provides incorrect or false information.
E.Wedel Chocolate Factory is not responsible for e-mail complaints that have been filtered by the Museum’s anti-spam system. The Museum’s decision on the complaint is final. This does not affect the statutory rights of the Visitor under the Polish Civil Code and the Act of May 30, 2014 on Consumer Rights (Dz. U. [Polish Journal of Laws] of 2017, item 683).
2. The purchase of an entrance ticket to the E.Wedel Chocolate Factory is tantamount to acceptance of these Regulations.
3. The current Regulations are available at www.fabrykaczekolady.pl (“Website”) and at the ticket counters of the E. Wedel Chocolate Factory. These Regulations may be updated from time to time. In this case, we will make the new version of the Regulations available on the Website and at the ticket counters of E.Wedel Chocolate Factory.
